South Africa’s Rule 41A of the Uniform Rules of Court is not just a suggestion—it’s a mandatory procedural requirement in civil litigation. Before you can serve a summons or launch an application, you must file a Rule 41A notice confirming whether you propose or oppose mediation.
💡 While participation in mediation remains voluntary, considering it is not. The courts now expect parties to engage meaningfully with the possibility of alternative dispute resolution before proceeding to trial.

The plaintiff or applicant must serve a Rule 41A notice stating whether they agree to mediation. The respondent must also file their position in response.
